1. Agreement to Terms

By accessing or using Markly, operated by Hyperhire Co., Ltd. (하이퍼하이어주식회사), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

Markly is an AI-powered logo generation service that helps users create brand logos through a guided 3-step process. The service uses artificial intelligence to generate symbol concepts, style variations, and complete logo asset packages.

3. User Accounts

3.1. You must provide accurate information when creating an account via Google authentication.

3.2. You are responsible for maintaining the security of your account.

3.3. You must not share your account or allow others to access your account.

3.4. We reserve the right to suspend or terminate accounts that violate these terms.

4. Credits and Payments

4.1. Markly operates on a credit-based system. 1 credit = 1 complete logo project.

4.2. Credits are purchased through our secure payment processor (Stripe).

4.3. Credits do not expire and remain in your account until used.

4.4. Prices are subject to change with notice. Existing credits are not affected.

4.5. All purchases are final unless covered by our Refund Policy.

5. Free Trial

5.1. Each user is entitled to one free trial (Step 1 only) per device/network.

5.2. Free trial is tracked by IP address and browser cookies.

5.3. Attempting to circumvent free trial limits may result in account suspension.

6. Intellectual Property

6.1. Your Content: You retain ownership of brand names and descriptions you submit.

6.2. Generated Logos: Upon successful completion of a project using a paid credit, you receive a full commercial license to use the generated logos for any purpose, including commercial use.

6.3. Our Service: Markly's technology, interface, and AI models remain the property of Hyperhire Co., Ltd.

6.4. No Exclusivity: AI-generated designs are not guaranteed to be unique. Similar outputs may be generated for other users.

7. Acceptable Use

You agree not to use Markly to:

Create logos for illegal activities or hate groups
Generate content that infringes on third-party trademarks or copyrights
Abuse the service through automated scripts or bots
Resell credits or access to the service
Reverse engineer or attempt to extract our AI models

8. Disclaimer of Warranties

MARKLY IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED LOGOS WILL MEET YOUR SPECIFIC REQUIREMENTS. AI-GENERATED CONTENT MAY OCCASIONALLY PRODUCE UNEXPECTED RESULTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPERHIRE CO., LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use of Markly after changes constitutes acceptance of the new terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes shall be subject to the exclusive jurisdiction of the courts in Seoul, Korea.
